Welcome to Capifront. These Terms of Service ("Terms") form a binding agreement between you and Capifront ("Capifront", "we", "us", or "our") governing your access to and use of our website, evaluation program, simulated trading accounts, and related services (together, the "Service"). By accessing or using the Service, creating an account, or purchasing an evaluation, you agree to be bound by these Terms. If you do not agree, do not use the Service. Please read them carefully.
In these Terms: "Evaluation" means the challenge program used to assess simulated trading performance; "Funded Account" means a simulated account offered after a successful Evaluation; "virtual funds" means the notional (non-real) balance used on all accounts; "you" or "trader" means the individual using the Service; and a "payout" means a discretionary real-money reward calculated on simulated profits. Headings are for convenience only and do not affect interpretation.
Capifront provides an evaluation program and simulated (demo) trading accounts that use virtual funds only. No real capital is ever deposited, traded, or at risk on your accounts, and no real orders are ever sent to any market, exchange, or liquidity provider. Prices, charts, balances, and performance shown are for evaluation and illustration only and may not reflect real-time or executable market conditions.
Capifront is not a broker, dealer, exchange, or financial institution and does not provide brokerage, investment, asset-management, custody, or money-transmission services. We do not give financial, legal, tax, or investment advice, and nothing in the Service is a recommendation to trade any instrument. Any payout you may receive is a discretionary reward for performance on a simulation — not investment income, profit from real trading, or a return on capital. See our Risk Disclosure for more.
To access an Evaluation you pay a one-time fee based on the selected account size. The fee grants access to the Evaluation program only and does not represent a deposit, investment, or trading capital; it is not held on your behalf and confers no ownership interest. Fees are stated at checkout and may be subject to applicable taxes. We may change fees, account sizes, and program parameters at any time, but changes do not affect an Evaluation you have already purchased. Refund eligibility is described in our Refund Policy.
Your use of every account is governed by the published Trading Rules & Objectives, which are incorporated into these Terms by reference. These include the maximum daily loss, maximum overall loss, profit target, any minimum or maximum trading days, and permitted instruments and strategies. Breaching a rule may result in the account being failed or closed without refund.
You agree not to engage in, attempt, or assist any of the following. Violations may lead to immediate account termination without refund, forfeiture of pending payouts, and, where appropriate, referral to authorities:
You must be at least 18 years old and legally permitted to use the Service in your jurisdiction. The Service is not available where prohibited by law or sanctions. You are responsible for the accuracy of your registration information, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use.
The Service and all content on it — including the "Capifront" name, logos, trademarks, text, graphics, interfaces, software, and the arrangement of the platform — are owned by Capifront or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, reproduce, modify, distribute, frame, scrape, or create derivative works from any part of the Service without our prior written permission.
Your use of the Service is also governed by our Privacy Policy, which explains what information we collect, how we use it, and your choices. By using the Service you consent to the data practices described there.
We may suspend, restrict, or terminate your access to the Service or any account, and cancel pending payouts, at any time and without prior notice, if we reasonably believe you have breached these Terms or the Trading Rules, engaged in prohibited conduct, or created legal or reputational risk for Capifront. You may stop using the Service at any time. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity, and governing law — will continue to apply.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. All account balances, prices, statistics, and performance figures are illustrative simulated data and do not represent real trading, real returns, or amounts you are entitled to receive. We do not warrant that the Service will meet your expectations or that any result on the simulation can be replicated in live markets. Trading involves significant risk — see our Risk Disclosure.
To the maximum extent permitted by law, Capifront and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or related to your use of (or inability to use) the Service, even if advised of the possibility. To the extent liability cannot be excluded, our total aggregate liability to you for all claims will not exceed the amount of Evaluation fees you paid to us in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Capifront and its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your use of the Service, your breach of these Terms or the Trading Rules, or your violation of any law or third-party right.
These Terms are governed by the laws of [jurisdiction to be specified], without regard to conflict-of-law principles. The courts of [jurisdiction to be specified] will have exclusive jurisdiction over any dispute, except where mandatory local consumer law provides otherwise. You agree to first attempt to resolve any dispute with us informally by contacting us before pursuing formal proceedings.
Capifront is not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages, failures of third-party providers or payment processors, cyberattacks, acts of God, war, civil unrest, labor disputes, or governmental action.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes may be communicated through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms, together with the policies referenced in them, are the entire agreement between you and Capifront regarding the Service. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
